I tested your code (just copy and paste plus necessary minimal modifications) and Create Report File dialog is modol. Tested with MicroStation V8i (SELECTseries 4).
To be sure we are talking about the same thing: A dialog is modal if it blocks a rest of an application and a user has to react before the application can continue. From this perspective the dialog using mdlDialog_fileCreate function is modal, because you have to close it before any other MicroStation function can continue.
Does the dialog behave differently in your MicroStation?
